1. Acceptance of Terms

By accessing the Gosa Racket Club website (the "Site"), booking a court, or enrolling in any academy program, you agree to be bound by these Terms and Conditions and all applicable laws and regulations in Monterrey, Nuevo León. If you do not agree with any of these terms, you are prohibited from using or accessing this Site or our physical facilities located at 2a. Zona 512, Caracol, 64810 Monterrey, N.L.

2. Membership and Account Security

To access certain features (such as the member-only booking portal), you must create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at [email protected] of any unauthorized use of your account.

Memberships are personal and non-transferable. Sharing your membership card or digital access code with third parties is strictly prohibited and may result in immediate termination of membership without refund.

3. Court Booking and Cancellation Policy

Gosa Racket Club maintains a strict booking policy to ensure fair play for all members:

• Advance Booking: Members may book courts up to 7 days in advance. Non-members are limited to 48 hours in advance.
• Cancellation Window: Cancellations made more than 24 hours before the scheduled time will receive a full credit to their club account.
• Late Cancellations: Cancellations made within less than 24 hours of the booking time are non-refundable.
• No-Shows: If a player fails to show up within 15 minutes of the start time, the court may be reassigned, and the full fee will be charged.

4. On-Court Rules and Dress Code

To maintain the quality of our professional Clay and Hard courts, all players must adhere to the following:

• Footwear: Only non-marking tennis shoes are permitted. Running shoes or hiking boots are strictly prohibited as they damage the court surface.
• Attire: Proper athletic tennis attire is required at all times.
• Equipment: Players are responsible for their own rackets unless rented from our Pro-Shop.
• Conduct: Profanity, racket throwing, or aggressive behavior toward staff or other players will result in immediate removal from the premises.

5. Waiver of Liability and Assumption of Risk

Physical activities, including Tennis and Padel, involve inherent risks of injury. By using our facilities at 2a. Zona 512, Caracol, you voluntarily assume all risks related to such activities.

Gosa Racket Club, its owners, and employees shall not be liable for any personal injury, property damage, or loss of personal items occurring on the premises. Members are advised to have their own medical insurance coverage.

6. Junior Academy Terms

Parents or legal guardians must sign a specific minor waiver before any child under 18 can participate in academy sessions. Gosa Racket Club is not a daycare facility; parents must ensure children are dropped off and picked up promptly according to the session schedule.

7. Payments, Fees, and Taxes

All prices listed on our Site are in Mexican Pesos (MXN) unless stated otherwise. Monthly membership fees are charged on the 1st of each month. Failure to pay will result in a suspension of booking privileges. We reserve the right to change our fees with 30 days' notice provided via email.

8. Intellectual Property

All content on this Site, including logos, designs, text, and photos, is the intellectual property of Gosa Racket Club. You may not reproduce, distribute, or create derivative works from this content without express written permission.

9. Modifications to Service

We reserve the right to close courts for maintenance, tournaments, or weather-related safety issues (e.g., heavy rain in Monterrey). In such cases, we will attempt to notify affected players via WhatsApp or Email and provide a booking credit.

10. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Nuevo León, Mexico. Any disputes arising from these terms shall be resolved in the competent courts of Monterrey.
